Divorce Certificate to be replaced with Divorce Order commencing 13 February 2010

Commencing 13 February 2010, divorce certificates will be replaced by a divorce order.

The following additional matters not included in a divorce certificate will be included in divorce order:

  • All of the matters that have been considered by the judicial officer in pronouncing the divorce order;
  • Where there are children of the marriage, the name of all children of the marriage;
  • Where there are children of the marriage who have not attained 18 years of age, the court's finding that:
  • Proper arrangements in all the circumstances have been made for the care, welfare and development of those children; or 
  • That there are circumstances by reason of which the divorce order should take effect even though the court is not satisfied that such arrangements have been made.

The divorce order will include a certification that the divorce has taken effect.

A separate divorce certificate will not issue.

Replacement divorce certificates will not issue (including for divorces obtained prior to 13 February 2010).

The purpose of the change is to facilitate recognition of divorce orders in foreign countries.
