The parties to a marriage may apply for a divorce twelve months after separation.

An application for divorce may be filed with the Federal Magistrates Court of Australia.

The application may be filed by one of the parties to the marriage, or jointly.

An application filed by one party alone must be served upon the other party and an acknowledgment of service filed with the court.

A filing fee is payable.

Exceptions to the twelve month separation rule include: periods of 'separation under one roof', marriage of less than two years duration.
