Family Violence, Intervention Orders and Personal Protection Orders and Family Law

 

A person who was been subjected to, or believes they may be subjected to, family violence may apply to the Magistrates Court of Victoria for an 'Intervention Order' or to the Family Court/Federal Magistrates Court for an order or injunction providing for their personal protection.

 

An Intervention Order or Personal Protection Order may prohibit a named person from approaching, or entering the home/work place/school or other location of, a protected person.

 

A child may be included in an order as a protected person.

 

'Family Violence' is defined in the Family Law Act as 'conduct, whether actual or threatened, by a person towards, or towards the property of, a member of the person's family that causes that or any other member of the person's family reasonably to fear for, or reasonably to be apprehensive about, his or her personal well-being or safety.' (section 4, Family Law Act).
