Superannuation entitlements may be 'split' between the parties to a marriage or de facto relationship.

 

Since late 2002 the superannuation entitlements of separated parties to a marriage have been able to 'split' and 'flag' their superannuation entitlements.

 

The same rights are now available to the parties of a de facto relationship that broke down on or after 1 March 2009.

 

Legal advice is recommended to ensure that superannuation entitlements are properly treated, including ascertaining the nature and value of the entitlements and affording procedural fairness to the trustee of the superannuation fund.
